Terms & Conditions

By creating an account, accessing or using Tradie Mate ("the Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a binding legal agreement between you ("User", "you", "your") and Tradie Mate Pty Ltd ("we", "us", "our", "Company"), a company registered in Australia.

We may update these Terms from time to time. If we make material changes, we will notify you at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.

To use the Service, you must register for an account and provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must be at least 18 years old and have the legal capacity to enter into contracts. If you are using the Service on behalf of a business, you confirm that you are authorised to bind that business to these Terms.

You must notify us immediately of any unauthorised access to or use of your account. We reserve the right to suspend or terminate accounts where we suspect fraudulent, abusive or illegal activity.

Tradie Mate is offered on a subscription basis. You choose a plan (Starter, Pro or Team) and are billed monthly in advance via Stripe. All prices are in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated.

Recurring billing

Your subscription automatically renews each month on the anniversary of your sign-up date. You authorise us (via Stripe) to charge your nominated payment method for the subscription fee plus any applicable taxes.

Plan changes

You may upgrade or downgrade your plan at any time from your account settings. Upgrades take effect immediately; downgrades take effect at the start of the next billing cycle. We do not provide partial refunds for mid-cycle downgrades.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. You retain access to the Service until that date. After cancellation, your account enters a 90-day grace period before data deletion.

Failed payments

If a payment fails, Stripe will attempt to retry the charge automatically. If payment continues to fail, we may suspend your account until the outstanding amount is settled.

Refunds

We do not offer refunds for partial months or unused features. If you believe you have been charged in error, contact us within 14 days of the charge and we will investigate. Refunds are issued at our sole discretion.

Payment processing is handled by Stripe, a PCI-DSS Level 1 certified payment provider. By subscribing to or accepting payments through Tradie Mate, you also agree to Stripe's Terms of Service and Privacy Policy.

Tradie Mate does not store your payment card details. All card data is collected, processed and stored directly by Stripe. We receive confirmation of successful or failed payments, along with transaction references, to update your invoice status.

You are responsible for ensuring your customers' payments comply with Australian consumer law. We provide payment links as a convenience; the contractual relationship for goods and services remains between you and your customer.

You agree not to use the Service to:

• Send unsolicited spam, harassment or illegal communications to customers
• Upload, transmit or distribute malware, viruses or malicious code
• Attempt to gain unauthorised access to the Service, its systems or other users' data
• Reverse engineer, decompile or extract source code from the Service
• Use the Service in a way that violates any applicable law or regulation
• Impersonate another person or misrepresent your trade qualifications or licences
• Resell, sublicense or commercially exploit the Service without written permission

We reserve the right to suspend or terminate any account that breaches this section, without notice or liability.

Tradie Mate uses artificial intelligence to transcribe voice recordings, generate quotes, invoices, follow-up messages and other documents. These outputs are generated automatically and may contain errors, omissions, inaccuracies or inappropriate language.

You are solely responsible for reviewing, editing and approving every AI-generated quote, invoice, message or document before sending it to a customer. Tradie Mate is a productivity tool to assist you, not a substitute for your professional judgment, trade expertise or compliance obligations.

We do not guarantee that AI-generated outputs will be accurate, complete, legally compliant or suitable for your specific circumstances. You assume full responsibility for the content you send to customers.

You are responsible for:

• Ensuring your trade licences, registrations and insurance are current and valid
• Complying with Australian consumer law, building codes and trade regulations in your jurisdiction
• Obtaining necessary customer consents before storing their personal information
• Keeping accurate financial records for tax and accounting purposes
• Paying any GST, income tax or other taxes applicable to your business
• Backing up critical business data independently of our platform

Tradie Mate does not provide legal, accounting, tax or compliance advice. Nothing in the Service should be construed as professional advice. If you require legal, tax or accounting guidance, consult a qualified professional.

We aim to keep the Service available 24/7, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable for scheduled maintenance, updates, bug fixes or due to circumstances beyond our reasonable control (including internet outages, third-party failures or force majeure events).

We are not liable for any loss or damage arising from downtime, data loss or service interruption, except where required by Australian consumer law.

Your content

You retain all ownership rights to the content you create, upload or generate using the Service (including customer lists, quotes, invoices and voice recordings). By using the Service, you grant us a limited, non-exclusive licence to use, host and process that content solely for the purpose of operating and improving the Service.

Our content

All software, code, designs, logos, branding, documentation and other materials provided by Tradie Mate are our property or licensed to us. You are granted a limited, non-transferable, non-exclusive licence to use the Service for its intended purpose. You may not copy, modify, distribute or create derivative works from our intellectual property without written permission.

To the maximum extent permitted by Australian law, our total liability to you for any claim arising out of or relating to these Terms or your use of the Service is limited to the total amount you paid us in the 12 months preceding the claim.

To the extent permitted by law, we are not liable for:

• Indirect, incidental, special, consequential or punitive damages
• Lost profits, lost revenue, lost business opportunities or reputational harm
• Errors or inaccuracies in AI-generated content that you send to customers
• Loss of data resulting from your failure to maintain independent backups
• Third-party payment failures, chargebacks or fraud

Nothing in these Terms limits or excludes your rights under the Australian Consumer Law where it would be unlawful to do so.

You agree to indemnify and hold harmless Tradie Mate, its directors, officers, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to:

• Your breach of these Terms
• Your misuse of the Service
• Any quote, invoice, message or document you send to a customer
• Any violation of applicable laws or third-party rights

We may suspend or terminate your access to the Service immediately if you breach these Terms, engage in illegal activity, or if required by law. Upon termination:

• Your right to use the Service ceases immediately
• Any outstanding fees become immediately due
• We may delete your data in accordance with our data retention policy

Provisions that by their nature should survive termination (including intellectual property, liability limitations, indemnity and governing law) will survive.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, store and protect your personal information. By using the Service, you agree to the terms of the Privacy Policy.

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
